US Judge Orders Freedom of Kilmar Abrego Garcia from Immigration Custody
A court has ordered the prompt release of Kilmar Abrego Garcia from detention by ICE, finding his continued detainment lacks legal authority.
"Since Abrego Garcia's return from wrongful imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," the judge stated in her ruling.
The case originates in a mistaken removal to El Salvador in March, which US authorities later acknowledged was an mistake. After his return to the United States to answer alien smuggling charges, he was detained in immigration custody.
In her order, the court noted that the government lacks a current deportation order, which prevents them from removing Mr. Abrego Garcia "at this juncture."
Context of the Case
The legal proceedings involve conflicting claims. Whereas the Trump administration argues that Abrego Garcia is a member of the MS-13 criminal organization, he vehemently disputes this allegation.
He has also pleaded not guilty to the conspiracy charges, which are part of a ongoing trial in Tennessee.
Conditions of Freedom
The judge, who was hearing his petition to removal in a federal court, determined that he must now comply with the conditions of his release from custody in Tennessee. This decision effectively transfers his supervision to the jurisdiction handling his criminal case.
This ruling marks a notable turn in a complex legal battle featuring allegations of mistaken imprisonment and contested criminal affiliations.
